No permission is given by Karnac Books Limited in respect of the use of any such brand names, product names or titles or copyrights and such use may constitute an infringement of the holder's rights.

However, any losses incurred or sustained by customers who transmit information by means of email or other internet link shall be borne solely and exclusively by that customer and in no event shall any such losses in whole or in part be borne by Karnac Books Limited. If you are using a public computer, you must sign out when you have finished shopping.

If you discover that goods have been ordered using your credit/debit card by someone not authorised to do so, Karnac Books Limited will refund to you the money it receives provided that:

(a) you inform your credit/debit card company and Karnac Books Limited of the unauthorised purchase as soon as you discover it; and

(b) you co-operate with your credit/debit card company, Karnac Books Limited and, if necessary, the police in relation to the unauthorised use.

Terms and Conditions for the Supply of Karnac Books Limited Products

The contract between us

Karnac Books Limited must receive payment of the whole of the price for the goods that you order before your order can be despatched. Orders are charged at the time of despatch, and only items being despatched at the time are charged for; once payment has been received Karnac Books Limited will confirm that your order has been processed by sending an email to you at the email address you provide in your order form. Karnac Books Limited' receipt of your payment brings into existence a legally binding contract between us.

Price

Karnac Books Limited reserves the right at any time to revise its prices without notice, and Karnac Books Limited makes no representations or warranties about the accuracy of said prices. However, we will take all reasonable steps to inform customers of any price changes before orders are processed and charges are made, and will give customers the option of cancelling any orders before said charges are brought into effect.

You will be required to pay extra for delivery to some destinations or by certain delivery methods (such as overnight, courier or signed-for services) and it might not be possible for us to deliver to some locations.

Withdrawal by you from the contract

You may withdraw your order for goods at any time up to the end of the fourteenth day after receipt of your order even if you have then already received the goods. You do not need to give Karnac Books Limited any reason for withdrawing your order nor will you have to pay any penalty.

The only circumstances in which you cannot withdraw your order are where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered.

To withdraw your order you must notify Karnac Books Limited in writing at the address set out in the Karnac Books Limited contact details page of this Web site.

If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their sealed package, you must send them back to the Karnac Books Limited contact address at your own cost and risk. If you withdraw your order but Karnac Books Limited has already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to Karnac Books Limited at the Karnac Books Limited contact address at your own cost and risk as soon as possible.

Once you have notified Karnac Books Limited that you are withdrawing your order, any sum debited to Karnac Books Limited from your credit/debit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by Karnac Books Limited in the condition they were in when delivered to you.

Availability of goods you order

If Karnac Books Limited has insufficient stock to deliver the goods ordered by you, any sum debited by Karnac Books Limited from your credit/debit card will be re-credited to your account and Karnac Books Limited will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Karnac Books Limited will not be obliged to offer any additional compensation for disappointment suffered.

Delivery of goods to you

Karnac Books Limited will deliver the goods ordered by you to the address you give Karnac Books Limited for delivery at the time you make your order.

You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and Karnac Books Limited will not be liable for their loss or destruction.

Liability

If the goods Karnac Books Limited delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Karnac Books Limited shall have no liability to you unless you notify Karnac Books Limited in writing at the Karnac Books Limited contact address of the problem within 10 working days of the delivery of goods in question.

If you do not receive goods ordered by you within 40 days of the date on which we despatched them to you (with the exception of items sent via surface post), Karnac Books Limited shall have no liability to you unless you notify Karnac Books Limited in writing at the Karnac Books Limited contact address of the problem within 50 days of the date on which you ordered the goods.

If you notify a problem to Karnac Books Limited under this condition, Karnac Books Limited only obligation will be, at its option:-

to make good any shortage or non-delivery;
to replace or repair any goods that are damaged or defective; or
to refund to you the amount paid by you for the goods in question in whatever way Karnac Books Limited chooses.

Karnac Books Limited will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Karnac Books Limited under this condition and Karnac Books Limited shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the paragraph above.

Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Karnac Books Limited' liability to you for any death or personal injury resulting from its negligence.

Force Majeure

Karnac Books Limited reserves the right to cancel, suspend or vary the operation of our obligations to you if events occur which are in the nature of force majeure including (but without prejudice to the generality of the foregoing) fire, flood, storms, plant breakdowns, strikes, lock outs, riot, hostilities, non-availability of material or suppliers or any event outside of Karnac Books Limited’ control; and we shall not be held liable for any breach of contract or tort resulting from such an event.

Invalidity

If any part of these conditions is unenforceable (including any provision in which Karnac Books Limited excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement

These terms and conditions, together with the current Karnac Books Limited Web site prices, delivery details and Karnac Books Limited contact details, set out the whole of our agreement relating to the supply of the goods to you by Karnac Books Limited.

These terms and conditions cannot be varied except in writing signed by a director of Karnac Books Limited. In particular nothing said by any sales person on behalf of Karnac Books Limited should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Karnac Books Limited. Karnac Books Limited shall have no liability for any such representation being untrue or misleading.

Interpretation

In these terms and conditions:-

any connected organisation that actually supplies goods ordered by you and any successor to its business;
"working day" means every day of a calendar year apart from weekends and statutory and public holidays;
"us" means Karnac Books Limited and you together; and
"you" and "your" means the person ordering goods under these terms and conditions.

Returns

If you have bought a book online and would like to return it, you can do so by returning the item to our mail order department. All you need is the book and your Karnac Books Limited receipt. As long as it is in the condition in which it was received, we will willingly exchange it or give you a Karnac Books Limited credit note to match the value of the book on the receipt. The value of this credit will be deducted from the value of your next order.

* If the book is damaged when you receive it, we will fully refund your credit/debit card to match the value of the book on the receipt, including the postage.

* Please note that Karnac Books Limited cannot refund postage.
